Honestly im not sure that this is legit with goggle ,though if it is i think ill give up on the scenery design as everyone would be able to get better imagery than i can afford ,seeing id have to pay for it for commercial use , id only be able to sell buildings and that seems to be a half package and not really the way payware scenery works .

I think selling scenery as a package without the ground texture could work?

Example. You create the whole hamilton region and airport in 3D to fit the Google Project and I'm sure it will be worth every dollar you think its worth now with the LINZ texture. Why wouldn't someone pay for the same stuff but have the option of putting it on their freeware Google Project?

I don't want to ruffle any feathers here, but the idea that anyone would give up scenery design based on the ground textures alone is crazy! You have a huge talent that everyone would be happy to pay for, but, if the highres textures cost too much, surely this is a good option??

The art of scenery design is getting the photos first off, then making the models/placing them.

Eg, I have downloaded some high res ground images for Wellington and put it underneath my RealNZ. Now it looks even better than before but only because I have the custom buildings to go on top of it.

The reality is, you cannot legally distribute Google imagery without explicit, written permission from the copyright holder.

As far as I'm aware, the current conditions controlling the use of Google is pretty clear:

QUOTE
2. Restrictions on Use. Unless you have received prior written authorization from Google (or, as applicable, from the provider of particular Content), you must not:
(a) access or use the Products or any Content through any technology or means other than those provided in the Products, or through other explicitly authorized means Google may designate (such as through the Google Maps/Google Earth APIs);
(b) copy, translate, modify, or make derivative works of the Content or any part thereof;
© redistribute, sublicense, rent, publish, sell, assign, lease, market, transfer, or otherwise make the Products or Content available to third parties;
(d) reverse engineer, decompile or otherwise attempt to extract the source code of the Service or any part thereof, unless this is expressly permitted or required by applicable law;
(e) use the Products in a manner that gives you or any other person access to mass downloads or bulk feeds of any Content, including but not limited to numerical latitude or longitude coordinates, imagery, and visible map data;
(f) delete, obscure, or in any manner alter any warning, notice (including but not limited to any copyright or other proprietary rights notice), or link that appears in the Products or the Content; or
(g) use the Service or Content with any products, systems, or applications for or in connection with (i) real time navigation or route guidance, including but not limited to turn-by-turn route guidance that is synchronized to the position of a user's sensor-enabled device; or (ii) any systems or functions for automatic or autonomous control of vehicle behavior.[/quote]

That's pretty clear. This info is available here.

There's also 3(f):
download any file posted by another that you know, or reasonably should know, cannot be legally distributed in such manner;

So it is illegal to supply any Google-sourced imagery, and illegal to download it.

Until this changes, the forum rules specifically prevent discussion of sourcing Google images other than legally.

Oh well, that puts that to bed. Thanks for clearing that up Robin.

I will discontinue any discussion regarding this project. I still have no easy solution regarding my Te Kowhai scenery, but nevermind.

If you read further it says all that applies only to FSX scenery, its actually fine to do it as long as its for FS9 scenery tongue.gif

Hi Deeknow,

I haven't done a thing on for months now. In fact I haven't even fired up flightsim in months now :-(

I have just recently started up my own business which has my full attention and therefor everything else has taken a back seat. A friend of mine has been keen to take over where I left off but I am not sure how he is going?
I'll do some digging and see if he is progressing.

Cheers,
Matt
